By using the Humanlinks website or group of websites (the "Web site" or "Humanlinks") and the softwares (the "Humanlinks Applications" or "Humanlinks") you agree to be bound by these Terms and Conditions (this "Agreement"). If you wish to become a Member (by signing up for registration) and communicate with other Members and make use of the Humanlinks services (the "Service"), read these Terms and Conditions and indicate your acceptance of them by following the instructions in the sign up pages. Eligibility and Registration You must be 18 years or older to use the Humanlinks services. By registering for the Humanlinks service, you represent and warrant that you are 18 or older and that you have the capacity to understand, agree to and comply with these Terms and Conditions. Humanlinks proprietary rights By submitting, posting or displaying any materials on or through the Humanlinks service, you automatically grant to us a worldwide, non-exclusive, sub-licenseable, transferable, royalty-free, perpetual, irrevocable right to copy, distribute, create derivative works of, publicly perform and display such materials. That said, we will never rent, sell or share your personal information with any third party for marketing purposes without your express permission.Humanlinks and its affiliates and licensors own and retain all rights in the Humanlinks Web sites and services, which contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by Humanlinks, you may not copy, modify, publish, transmit, distribute, perform, display or sell any of Humanlinks proprietary information. "Humanlinks" and "Humanlinks.com" are trademarks of Humanlinks Technologies Pvt. Ltd. You must use the Service in a manner cnsistent with any and all applicable laws and regulations. Limitation on LiabilityExcept in jurisdictions where such provisions are restricted, in no event will Humanlinks be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Web site or the Service, even if Humanlinks has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Humanlinks liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Humanlinks for the services during the term of membership. Governing Law and Venue.By visiting or using the Web site and/or the services, you agree that the laws of India, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and Humanlinks, or any of its affiliates. Any dispute relating in any way to the Web site and/or the Service (including your visit to or use of the Web site and/or the Service) shall fall in jurisdiction of the Courts of Delhi. Indemnity.You agree to indemnify and hold Humanlinks, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above. OtherThis Agreement, accepted upon use of the Web site and further affirmed by becoming a mmber of the services, contains the entire agreement between you and Humanlinks regarding the use of the Website and/or the services. The failure of Humanlinks to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. The section titles in these Terms and Conditions are for convenience only and have no legal or contractual effect. Candidates and Referrers The candidates and the referrers by using the services of Humanlinks agree to the following clauses. 1. Humanlinks offers no guarantee nor warranties that there would be a satisfactory response or any response at all once the resume/ insertion or information/data is fed by the user. Humanlinks neither guarantees nor offers any warranty about the credentials bonafides, status or otherwise of the prospective employer/organization which downloads the resume/ insertion or information/data and uses it to contact the user. 3. Humanlinks neither guarantees nor offers any warranty about the credentials bonafides, status or otherwise of the prospective employer/organization which downloads the resume/ insertion or information/data and uses it to contact the user. 4. The candidates and the referrers by using the services of Humanlinks accept that the basis of calculation of bonuses are as given below and accept the following: b) Taxes and other statutory deductions, as applicable, will be deducted from the eligible bonus amounts for the selected candidates and referrers. c) The bonuses related to any one position are one time payments. No repeat payment can ever become due to a candidate or referrer for the same one position. d) Humanlinks reserves the right to ask for all relevant documents including appointment letters (for new and past companies) and payslips. Wherever there is a difference of more than 10% between the CTCs/salaries of the old and new companies, Humanlinks reserves the right to ask for additional documents in addition to the above. Similarly, if there is a major change in the salary structure or CTC/slary amount in the past 30 days of leaving the old company, Humanlinks reserves the right to ask for whatever documents are required to authenticate the claims of the candidate / referrer. e) All bonuses become due for payment only on selection of the candidate and after such period which is determined based on Humanlinks’ agreement with its client company. f) Freshers are not eligible for joining bonuses as they never worked and hence their current salary is zero. g) The resumes are confidential as the name of the candidate and the company details are shown to the recruiter only when the candidates confirms his interest in the job. However, Humanlinks will not be responsible for any leakages in confidentiality of the candidate if the candidate provides his own and/or the company details (where he/she is working currently or was working in the past) in any field other than the one specifically provided for this purpose. 5. Uploading of multiple resumes beyond a reasonable limit by the same individual, using the same or different accounts shall entitle Humanlinks to remove the Resumes without notice to the subscriber. This service is only meant for candidates looking for suitable jobs. Any usage with commercial intent is prohibited. 6. Humanlinks reserves its right to reject and delete any resume/ insertion or information/data fed in by the user without assigning any reason.
8. The subscriber shall be assigned a password (s) by Humanlinks to enable the subscriber to access all the information received through Humanlinks, but the sole responsibility of the safe custody of the password shall be that of the subscriber and Humanlinks shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. Humanlinks undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber 9. It shall be the sole responsibility of the user to ensure that it uses the privacy setting options as it deems fit to debar / refuse access of the data fed by it, to such corporate entities individuals or consultants. Humanlinks shall not be responsible for such insertions / data being accessed by its subscribers or users whose access has not been specifically blocked /debarred by the user while using the privacy settings. 10. On registration you agree to: 11.The User of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the website. 12.Jurisdiction for any disputes arising from and related to this contest shall be New Delhi, India to the exclusion of all other courts. All disputes shall be resolved in accordance with the laws of India as applicable Recruiters, resume search & job posting 1.Humanlinks offers no guarantee nor warranties that there would be a satisfactory response or any at all response once the job is put on display. 2.Humanlinks shall in no way be held liable for any information received by the subscriber and it shall be the sole responsibility of the subscriber to check, authenticate and verify the information/response received at its own cost and expense. 3.The subscriber/Recruiter shall be deemed to give an undertaking to Humanlinks that the jobs sought to be advertised on the classified section of Humanlinks.com are in existence, are genuine and that the subscriber / recruiter has the authority to advertise for such jobs 4.Humanlinks reserves its right to change the look, feel, design, prominence, depiction, classification of the classified section of Humanlinks.com at any time without assigning any reason and without giving any notice. 5.The subscriber shall be assigned password (s) by Humanlinks to enable the subscriber to post vacancies on the site in agreed upon section(s), but the sole responsibility of the safe custody of the password shall be that of the subscriber and Humanlinks shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. Humanlinks undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber. 6.The User of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the website 7.All disputes arising out of the transactions between a user and Humanlinks will be resolved in accordance with the laws of India as applicable. 8.All Disputes arising out of the transactions between a user and Humanlinks will be subject to the jurisdiction of Courts situate in Delhi alone. 9.Humanlinks agrees to provide the service to the subscriber only for the duration contracted for to the best of its ability 10.Humanlinks reserves its right to suspend/terminate the services contracted for by the subscriber either prior to or during the contracted period without assigning any reason. In such an eventuality, any amount so paid for by the subscriber for this service, may be refunded by Humanlinks at a prorata basis to the subscriber at its discretion. 11.Humanlinks offers no guarantee nor warranties that there would be a satisfactory response or any response at all subscriber for applications received using the software 12.Humanlinks shall in no way be held liable for any information received by the subscriber and it shall be the sole responsibility of the subscriber to check, authenticate and verify the information/response received at its own cost and expense 13.Humanlinks would not be held liable for any loss of data technical or otherwise, information, particulars supplied by the customers due to the reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond Humanlinks's reasonable control including but not limited to strike, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities 14.The subscriber/Recruiter shall give an undertaking to Humanlinks that the jobs sought to be filled through Humanlinks.com are in existence, genuine and the subscriber has the authority to recruit /advertise for such vacancies. Also the subscriber undertakes that the database will be used to contact candidates for jobs only 15.Humanlinks reserves its right to change the look, feel, design, prominence, depiction, classification of any section of Humanlinks.com at any time without assigning any reason and without giving any notice 16.This subscription is neither re-saleable nor transferable by the subscriber to any other person, corporate body, firm or individual concern 17.The subscriber shall be assigned a password (s) by Humanlinks to enable the subscriber to access all the information received through the software, but the sole responsibility of the safe custody of the password shall be that of the subscriber and Humanlinks shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. Humanlinks undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber 18.The subscriber shall not use / circulate / forward a person's resume hosted on the Humanlinks to his / her current employer as mentioned by the person in his / her resume. 19.The User of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him or on his behalf on the website or supplied to HUMANLINKS. 20.All disputes arising out of the transactions between a user and Humanlinks will be resolved in accordance with the laws of India as applicable. 21. All Disputes arising out of the transactions between a user and Humanlinks will be subject to the jurisdiction of Courts situate in Delhi alone. Information Sharing and Disclosure
Humanlinks comand its affiliates, licensors, partners, suppliers, consultants and agents ("Humanlinks") disclaim any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information or materials displayed on the Humanlinks services. Humanlinks disclaims any and all responsibility and liability for the conduct of any Member. Hold harmless and indemnity You agree to hold harmless and indemnify Humanlinks from and against any third party claim arising from or in any way related to your use of the Humanlinks services, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, Humanlinks will provide you with written notice of such claim, suit or action. Limitation of liability Under no circumstances will Humanlinks be liable to you for any indirect, incidental, consequential, special or exemplary damages arising out of or in connection with use of the Humanlinks services, whether or not Humanlinks has been advised of the possibility of such damages. Such limitation of liability shall apply (i) whether the damages arise from use or misuse of and reliance on the Humanlinks service, from inability to use the Humanlinks service, or from the interruption, suspension, or termination of the Humanlinks service (including such damages incurred by third parties), and (ii) notwithstanding any failure of essential purpose of any limited remedy and to the fullest extent permitted by law. Under no circumstances shall Humanlinks be liable to you for any amount exceeding one thousand dollars ($1000.00). Term and termination These Terms and Conditions will apply to your use of the Humanlinks services. At any time, you can terminate your account which will remove your profile and other personal information from view. We may terminate your membership immediately at any time, for any reason. Once your membership terminates, you will have no right to use the Humanlinks services. Our proprietary rights, disclaimer of warranties, indemnities, limitations of liability and miscellaneous provisions shall survive any termination of your membership. Notices Humanlinks may provide you with notices regarding the services or these Terms and Conditions by regular mail, email, or postings on the Web site.
Without limiting the foregoing, under no circumstances shall Humanlinks be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning. Changes to Humanlinks and Terms and Conditions We reserve the right to modify or terminate the Humanlinks services for any reason, and without notice, without liability to you, any other Member or any third party. We also reserve the right to modify these Terms and Conditions from time to time without notice. You are responsible for regularly reviewing these Terms and Conditions so that you will be apprised of any changes.

Humanlinks is a place where users can express their own beliefs and values, and our community standards help foster a positive environment in which to do so. The standards are a living document and will change based on the needs of the broad community and the available tools, so we encourage users to review them frequently. We take the Humanlinks community standards seriously and ask you to respect them. As Humanlinks members, you have certain responsibilities to yourselves and to each other. The following guidelines are intended to protect Humanlinks members' privacy, legal rights and overall user experience. Note that these guidelines are not intended to replace the actual Terms and Conditions for Humanlinks. Potential community standards violations should be reported using the "Report Abuse" link on the Gateway Page of Humanlinks, providing all relevant details. If we determine that the reported content is illegal or violates our policies, we may immediately remove it. Humanlinks is a group of sites (linked to Humanlinks.com) designed to help professionals to connect and create engaging communities as well as applications around common interests. Humanlinks also provides incentives branded under different names to provide financial and other benefits to its members/ users. We often hear users tell us how Humanlinks has been useful to them. humanlink’s success has always been driven by our members’ ability to create engaging content. However, there will always be content that some people find offensive or inappropriate. Humanlinks derives its value from you, the users, and the content that you create. Similarly, we trust and rely on users to notify us of potential violations of our Terms and Conditions. When you do so, via email or by clicking the “Report Abuse” link that’s prominently displayed on Humanlinks Gateway Page, we manually review the profile or content or community in question, and if it violates our Terms and Conditions, we remove that content and disable the account from which it was created. Ultimately, the preservation and improvement of the Humanlinks experience is a responsibility we share with our members.
As a user you agree to any information you have entered on Humanlinks being stored in a database. While this information will not be disclosed to any third party without your consent the webmaster, administrator and moderators cannot be held responsible for any hacking attempt that may lead to the data being compromised. As you know, we encourage users to take full advantage of Humanlinks to post and share information freely. However, users should not post copyrighted material in their profiles or communities. We will remove such material if we receive a formal copyright complaint following the process described below.
To submit an official copyright complaint, you must own the copyright to the material in question or be authorized by the copyright holder to act on their behalf. You must clearly identify the material in question and provide us with the URL of the Humanlinks page on which it appears. Content An account should not upload, transmit or contain (in the profile, testimonials, scrapbook entries, etc.) material, such as child pornography, which violates real-world laws. These users will be immediately terminated when we become aware of such content, and we will report instances of child pornography to the appropriate authorities. Additionally, images displayed on Humanlinks.com should not contain nudity, sexually graphic material, or material that is otherwise deemed explicit by the Humanlinks team. Account Accounts should not be used for commercial purposes unless separately agreed to by contract with Humanlinks. An account should not be created by automated means or be used by an automated system to perform actions such as: creating new accounts; sending scraps, messages, testimonials or invitations; or creating communities. We may remove accounts found to be engaged in this type of activity. Similarly, an account which affects the general stability and/or integrity of the system may be suspended or terminated. Community Restrictions While we encourage users to take advantage of communities on Humanlinks to share ideas freely with one another, we have limitations on certain community content and behavior. Communities are subject to the following restrictions. Violation of any of these restrictions may result in the termination of a community. Needless to say, a community should not contain material, such as child pornography or pedophilia, which violates real-world laws. Additionally, images displayed on Humanlinks should not contain nudity, sexually graphic material, or material that is otherwise deemed explicit by the Humanlinks team. A community should not display material, or be used for activity, that is hateful or offensive based on race, ethnicity, national origin, religion, gender, or sexual orientation. A community should not contain direct threats of violence against any living person, nor should it promote any dangerous and illegal activity. A community which affects the general stability and/or integrity of the system may be suspended or terminated until the issue can be addressed. |
